The market landscape is changing rapidly and so are the needs of our Clients. As we evolve from being a predominantly print based publisher into a truly global, digital media company, our content, and the creative process through which it is conceived, becomes more complex. At the same time, copyright, free speech and other IP/Media laws are evolving and fragmenting. In order to respond to these changes, and because we cannot realise the opportunities of the digital marketplace without also managing the risks that are inherent within it, we are enhancing our approach to:
- Content, IP & Media law;
- Digital and Data law; and
- Sales and Commercial law
This role will assist with the development of our advice and support in the area of Content, IP & Media law. The purpose of your role is to help our Editorial and Video teams and other Creative colleagues shape their approach to IP acquisition, creation, protection and syndication. You will also ensure that other CN personnel approach their work with an awareness of how IP laws and CN IP policies work.
Specific Tasks will include:
Advise the editorial and video teams as well as others involved in content acquisition on IP negotiations and transactions;
Draft and negotiate a wide range of content acquisition agreements, including talent agreements, director agreements and contributor agreements.
Oversee the preparation and maintenance of IP templates and standard form documentation
2.IP Dispute Resolution
Support colleagues with the resolution of IP disputes and issues that arise;
Provide advice on the creation of IP assets, including around protection and registration where applicable;
Work with colleagues to propose and develop legal solutions, policies and models for new and emerging content types, with a particular focus on video, music and other multi-media content.
Provide legal support and advice to the IP Syndication process. Manage Rights Clearance.
Develop and maintain an awareness of IP regulatory matters in Mexico and use this to advise the business on possible trends that could affect future strategy.
6.IP & Employment
Support the Global Counsel, IP & Content Integrity and other colleagues with policies relating to the creation and exploitation of IP by employees
Provide advice and assistance on rights management, digital asset management and contract negotiation processes.
- Support the development of a best practice approach to IP and Media law so as to ensure efficient and cost effective legal service delivery;
- Build relationships with other IP lawyers in the CN Legal Community to identify opportunities for knowledge sharing, common ways of working and efficiencies;
- Engage with outside counsel where appropriate and necessary;
- Supporting the Global Counsel, IP & Content Integrity and other legal colleagues with management reporting and interactions with CN’s shareholder on IP & Media law matters;
- Proactively network within the IP & Media law community
Skills and Experience
Specialist experience in IP law gained either in private practice or in an in-house role in a similar sector, including a thorough knowledge of copyright and trade mark law;
Ability to present legal advice in a pragmatic, problem solving and commercial fashion
Positive “can do” attitude and willingness to work flexibly and as part of a new and evolving team that is itself operating in a business and sector going through change.
